2 C.F.R. Uniform Guidance: Subpart C (2 of 2)

Wow, if you are reading this blog post--pat yourself. You are just about to make through Subpart C of OMB Circular. Doesn't that feel amazing. So, let's roll-----------In today's blog post, we are going to finish the Subpart C; below you will find the sections that we will be covering beginning 200.208 thru 200.213. 

200.208  CERTIFICATIONS AND REPRESENTATIONS.

200.209  PRE-AWARD COSTS.

200.210  INFORMATION CONTAINED IN A FEDERAL AWARD.

200.211  PUBLIC ACCESS TO FEDERAL AWARD INFORMATION.

200.212  REPORTING A DETERMINATION THAT A NON-FEDERAL ENTITY IS NOT QUALIFIED FOR A FEDERAL AWARD.

200.213  SUSPENSION AND DEBARMENT. 

200.208  CERTIFICATIONS AND REPRESENTATIONS - According to the Federal regulations, the awarding agency or the pass-through entity can request the certifications and representation from the non-Federal entity on annual basis. Submissions may be required more frequently if non-Federal entity fails to meet the requirements. 

200.209  PRE-AWARD COSTS- All costs incurred before the grant was awarded. 

200.210 INFORMATION CONTAINED IN A FEDERAL AWARD - Per Guidelines, a Federal award must contain the following information: 

  (a) General Federal Award Information.

(1) Recipient Name (Must match the DUNS name) 

(2) Recipient's DUNS number

(3) Unique Federal Award Identification Number (FAIN) 

(4) Federal Award Date 

(5) Period of Performance Start and End Date

(6) Amount of Federal Funds Obligated by this action

(7) Total Amount of the Federal Award Obligated

(8) Total Amount of the Federal Award 

(9) Budget Approved by the Federal Awarding Agency 

(10) Total Approved Cost Sharing or Matching if applicable 

(11) Federal award project description (e.g. FFATA) 

(12) Name of Federal awarding agency and contact information 

(13) CFDA Number & Name

(14) Identification of whether the award is R&D

(15) Indirect cost rate for the Federal award including the de minimis rate

(b) General Terms & Conditions

(1) The following terms & conditions must be included by the Federal awarding agency: 

(i) Administrative requirements

(ii) National policy requirements

(2) The Federal award must include the wording to incorporate, by reference, and terms & conditions. 

(3) A non-Federal entity can request a copy of the full text of the general terms & conditions from the Federal awarding agency. 

(4) A Federal awarding agency must maintain an archive of previous versions of the general terms & conditions. 

(c) Federal Awarding Agency Program, or Federal Award Specific Terms and Conditions. The Federal awarding agency many include any terms & conditions necessary to communicate requirements in addition to the terms & conditions of the Federal award. 

(d) Federal Award Performance Goals. An indication of the timing and scope of the expected performance by the non Federal entity as related to the outcomes intended to be achieved by the program. The Federal award may include specific performance goals, indicators, milestones, or expected outcomes with an expected timeline for accomplishment. Reporting requirements must be clearly defined. There may be program-specific requirements as well. 

200.211  PUBLIC ACCESS TO FEDERAL AWARD INFORMATION - The Federal agency must announce all Federal awards publicly and publish the required information publicly on www.USAspending.gov 

200.212  REPORTING A DETERMINATION THAT A NON-FEDERAL ENTITY IS NOT QUALIFIED FOR A FEDERAL AWARD.

(a) If the Federal agency does not make an award to the non-Federal agency, it must be reported through SAM along with the risk posed by the applicant. 

(b) The Federal awarding agency is not required to report a determination that a non-Federal entity is not qualified for a Federal award if they make the award with specific award terms & conditions. 

200.213  SUSPENSION AND DEBARMENT - Awards, subawards, and contracts cannot be made to organizations that are debarred, suspended, or excluded from or ineligible for participation in Federal Assistance Programs or Activities.
